Terms of service

These are the terms for using kaitlian. They are a real agreement, written to be read. "kaitlian," "we," and "us" mean the kaitlian service, operated from Newport Beach, California. "You" means the person or business with a kaitlian workspace. By using kaitlian, you agree to these terms.

1. What kaitlian is

kaitlian is a subscription workspace where AI assistants do work for your business: building and hosting websites, editing videos, working with your files, sending email and text messages you approve, answering a phone line, and running work on schedules you set. The assistants are powered by AI from Anthropic, and their work is generated on your instructions.

2. Your account and your team

You sign in with an email address invited to your workspace. You are responsible for who you add to your team and for what your team asks the assistants to do. Keep your sign-in secure; anyone who can sign in as you can act as you.

3. Plans, budgets, and billing

  • Plans. Paid plans are billed monthly through Stripe and renew automatically each month, at your plan's rate, until you cancel. Each plan includes a monthly budget of assistant work, measured in dollars, plus the features listed on the pricing page. You can cancel online in Settings, anytime.
  • Work budgets. Your included budget refreshes each billing cycle. Unused included budget carries into the next cycle, up to one extra month's worth. Extra funds you add stay available while you are subscribed.
  • Trials. Trials are free, time-limited, and include a small work budget. When a trial ends, the assistants pause until you choose a plan. Your workspace and its contents stay viewable.
  • Founding rate. If your plan carries a founding rate, that rate is yours for as long as your subscription stays continuously active. If it lapses and you later return, the current listed price applies.
  • Guarantee. New subscriptions carry a 30-day money-back guarantee: ask within 30 days of your first charge and we will refund it.
  • Cancelling. You can cancel anytime. Your plan runs through the period you paid for, then stops. We do not prorate partial months outside the guarantee.
  • Changes. Listed prices and plan contents can change. Existing subscribers get at least 30 days' notice before a price change affects them. The founding-rate promise above always holds.

4. You stay in charge, and you check the work

Assistants ask before doing sensitive things: sending email or texts and similar outward actions wait for a person's approval. AI also makes mistakes, and it can be confidently wrong. You are responsible for reviewing work that matters, especially anything published, sent, legal, financial, or medical, before you rely on it or approve it.

5. Acceptable use

Use kaitlian for lawful business. Do not use it to send spam or unwanted messages, to harass or deceive people, to infringe others' rights, to attack or overload the service or anyone else's systems, or to do anything illegal. The phone and messaging features must be used consistently with the laws that govern calls and texts. We can suspend or close workspaces that break these rules.

6. Your content is yours

Everything you put in, and everything the assistants make for you, belongs to you: your files, your websites, your videos, your words. We claim no ownership. You give us only the permission needed to run the service: to store, process, and display your content so the assistants can work and your team can see the results. If you leave, ask and we will help you take your content with you.

7. The services under the hood

kaitlian runs on trusted providers: Anthropic for the AI, Cloudflare for hosting and storage, Stripe for payments, and Twilio for the phone line. Your use of kaitlian is also subject to what those providers reasonably require of us. We never see or store your card details; Stripe handles payment directly.

8. Our promises, and their limits

We work to keep kaitlian available, safe, and good. Still, the service is provided "as is." We cannot promise it will be uninterrupted or error-free, and we make no warranty about the accuracy of AI-generated work. To the fullest extent the law allows, our total liability for claims related to kaitlian is capped at the amount you paid us in the twelve months before the claim, and neither of us is liable for indirect or consequential damages. Nothing here limits liability the law says cannot be limited.

9. Ending things

You can close your workspace anytime. We can suspend or close a workspace for breaking these terms, for non-payment, or if we wind the service down, in which case you get reasonable notice and a way to take your content. Sections 6 through 10 survive the end of the agreement.

10. The legal frame

These terms are governed by California law, and disputes belong in the state or federal courts of Orange County, California. If we update these terms, the new version is posted here with a fresh date at the top; material changes get direct notice to workspace admins. If any part is found unenforceable, the rest still stands.

kaitlian may move its operation into a company formed to run it (such as a limited liability company). If that happens, this agreement, your subscription, and your founding rate move with it unchanged — you'll see the new name here, and nothing else about your service or price changes. You may not transfer your workspace or this agreement to someone else without asking us first.
